Defense wins: gold without the glitter; saving clients millions is the flip side of winning awards, but less dazzling
Article Abstract:
The 7th annual National Law Journal survey of the biggest defense wins in 1997 jury trials shows that it was a bad time for some successful plaintiffs' attorneys. The list is necessarily subjective, since defense wins cannot be rated by size. It would be misleading to rate these victories by the amount of damages asked for, since some plaintiffs ask for much more than their cases are worth. Moreover, defense attorneys often consider a verdict a win if damages won by the plaintiff are smaller than expected. National Law Journal rules for determining which defense wins were the most significant are listed.
