Discovery; designating testifying experts
Article Abstract:
Designating a testifying expert before trial may entail waiving the work-product and attorney-client privileges for all materials shared with that expert while he or she was a consultant. The 1993 amendments to the Federal Rules of Civil Procedure requires the production of all materials considered by the expert, while before material the attorney could shield included discovery work product.

Discovery; what's wrong with coaching?
Article Abstract:
Coaching witnesses should lose its pejorative connotation, as the only wrong or unethical thing is to coach witnesses to lie or to break the rules. Attorney's duty to clients is to coach witnesses to give their best, and this includes training a witness to do his or her best, and using techniques which bring out the best. Clients should dismiss attorneys who do any less.
