Drawing a line in the sand; suits by lifeguard, student to define standard for sexual harassment liability
Article Abstract:
The US Supreme Court will again consider the standard for sexual harassment liability in Faragher v. City of Boca Raton and Doe v. Lago Vista Independent School District. The former is a suit by a lifeguard complaining that she was sexually harassed by two beach supervisors employed by the city. Feminists and the Justice Department are urging a ruling that employers are liable if supervisors are given unlimited authority which they in turn use to harass employees. In the latter case, plaintiffs allege that a school district should be liable for sexual harassment of a student by a teacher.

The 1998 US Supreme Court cases of Faragher v. Boca Raton and Burlington v. Ellerth ruled that sexual harassment victims could prevail in a suit against their employers without suffering a direct job loss and even without having complained about the harassment. Plaintiffs lawyers were extremely happy, saying these rulings would compel affirmative steps by employers to prevent workplace harassment. Although the rulings could increase suits in the short term, these should diminish as employers adopt stronger policies against harassment.

The US Supreme Court has Davis v. Monroe County Board of Education pending, a sexual harassment case in which the mother wants the school district to pay damages for her daughter's harassment by a fellow fifth-grade boy. The suit was filed under Title IX of the Education Amendments of 1972, which prohibits sex discrimination in education programs receiving federal funds.
