High court ducks its own habeas question
Article Abstract:
Wright v West gave the US Supreme Court the opportunity to rule on a habeas corpus issue, namely, whether federal judges should review a state court's reading of constitutional law or defer to state judges' holdings. However, the justices stuck to the core issue originally raised and held that there was enough evidence to justify a larceny conviction. Scaling back habeas corpus rights has seemed to be a prime interest of the Rehnquist court, but in this case the justices were sharply divided.

Barr 'slam-dunked' by high court on prisons
Article Abstract:
Remarks by Attorney General William P. Barr on Jan 14, 1992 supporting modification of consent decrees on prison conditions conflicted with the Supreme Court decision in Rufo v. Inmates of Suffolk Co. Jail issued the next day. The court upheld the status quo in holding that consent decrees could not be modified without showing a significant change in facts or law. Barr indicated Justice Department support for requiring only the constitutional minimum.

Court: commercial speech deserves protection
Article Abstract:
The Supreme Court upheld the usage of newsracks to distribute advertising material in Cincinnati v Discovery Network, Inc, showing that commercial speech will be strongly supported. The City of Cincinnati banned commercial newsracks while allowing noncommercial newsracks, claiming protection of public aesthetics and safety. The decision used a reasonableness test from Central Hudson Gas & Electric v Public Service Commission of New York.
