Article Abstract:
The author examines the advice-of-counsel defense against bad-faith lawsuits for denial of a claim for defense or indemnity. The defense is seen from three perspectives, that of the extra-contractual counsel, the coverage counsel, and the claims professional.

The authors discuss claims of failure to compensate an insured for a loss covered by an insurance policy, or for unreasonably delaying insurance payments due under the policy. The authors address insurance coverage disputes between liability insurers and their insureds that result in assignments against the insurer.
