Attorney Michael R Arkfeld, author of 'The Digital Practice of Law,' compares the development of digital technology to the Industrial Revolution because it has permanently changed society from a paper-based to a digital one, and this digitalization of information allows information storage and retrieval and sending out over the Internet at any time. Arkfeld also calls technology a great equalizer, because it allows sole practitioners and small firm lawyers to compete on an equal footing with those employed by big firms.

The need for clear rules placing reasonable limits on e-mail discovery is discussed, and the key may be getting parties to agree to mutual parameters. Litigants should remember their document production duties while remaining sympathethic to the other side's practical difficulties.Discoveryin a 1995 case between Procter and Gamble and Amway is used for an example.
