Litigation concerning the wrongful deaths of patients in clinical trials and the novel theories used to back up some of these claims is discussed. Jesse Gelsinger, a teenager who died in a gene therapy experiment at the University of Pennsylvania, is the one most covered by the media. The lawyer representing Gelsinger's family claims a violation of the 14th Amendment.
