Article Abstract:
Several recent trends in franchise law can be extrapolated to the future. There will likely be more relationship laws for specialty industries, such as those that require good cause for termination or repurchase of inventory. Also, warehouse retailers are crowding out distributors by offering their goods below wholesale prices, which could lead to new law. Finally, the courts seem increasingly inclined to protect only those aspects of a franchise that are distinctive.

Article Abstract:
The two bills proposed in the House to establish federal laws for franchises have some serious flaws, but their basic intention of creating uniform rules across the nation is a good one. The great bulk of franchise legislation has concerned choice of law or choice of forum issues, as states vary greatly in their rules. The exposure of attorneys to liability, however, is a bad idea, as is the requirement of earnings claims.
