Smoke gets in your high-rise; tobacco-sensitive tenants increasingly sue over neighbors' nicotine habits
Article Abstract:
Suits by tobacco-sensitive tenants over their neighbors' smoking habits and against building owners and property managers have become common although plaintiffs have enjoyed only moderate success. Nonsmokers' biggest victory was a June 1998 award of $4,350 by a Boston housing court judge in Gainsborough St. Realty Trust v.Haile to a couple whose landlord failed to prevent smoke from the bar beneath from entering the apartment. Anti-smoking activists say the decision and growing awareness of the dangers of passive smoking will result in more litigation.
