The National Bankruptcy Review Commission, in its recently released report, has proposed significant changes affecting single-asset real estate debtors
Article Abstract:
The National Bankruptcy Commission issued a report in Oct 1997 on the Bankruptcy Reform Act of 1994 which would, if approved by Congress, change the bankruptcy law in important ways. Changes would include Chapter 11 single-asset real estate cases with the mortgage holder as the major creditor. The proposals would make such cases more certain, help expedite the process, and side with the debtor by making confirmation somewhat easier than under current law. Creditors would benefit because the major problems causing litigation would be eliminated.
