The Rill legacy: trustbusters are back on the beat

James F. Rill resigned on May 12, 1992, as head of the Justice Department's Antitrust Division and left a revitalized agency behind him. Staffing increased from 500 to 600 people, with a 30% increase in the number of lawyers. Rill has attempted to work together with antitrust enforcers abroad. He has not gotten along with the National Assn of Attorneys General Antitrust Task Force and both are drafting separate sets of revised merger guidelines. His successor, Charles A. James, will inherit an enforcement program whose success has waxed and waned in the courts.

Antitrust merger guidelines receive mixed reaction
Article Abstract:
The Department of Justice and the Federal Trade Commission (FTC) have released the 1992 horizontal merger guidelines. The guidelines delineate a five-step program for deciding whether to contest a proposed merger that might decrease competition and therefore violate antitrust laws. The guidelines also give a three-step analysis for deciding whether the entry of other competitors into a market would decrease a possible merger's anticompetitive effects. Some antitrust specialists think the guidelines are too complicated; others praise their flexibility.

Group at work on first guidelines for hospital mergers
Article Abstract:
Massachusetts lawyers and a group of antitrust enforcers are developing the first guidelines for evaluating hospital mergers in the wake of three investigations of proposed hospital mergers in 1992. At the federal level, however, antitrust enforcers and the American Hospital Assn (AHA) stand on opposite sides, with the AHA accusing the government of giving insufficient guidance on the antitrust scrutiny given proposed hospital mergers and advocating exemption of these activities from antitrust law.
