Nesbitt Burns rejects federal act in Bre-X case
Article Abstract:
Nesbitt Burns Inc.'s lawyer John Champion questioned the lawsuit filed by shareholders who lost money in their investment in Bre-X Mineras Ltd. The shareholders invoked the Federal Competition Act provision against false advertising in their lawsuit. According to Champion, the federal act can not be used by the shareholders because it it would infringe on provincial responsibility for securities regulation. The act could not be used also for there is no proof of anti-competitive action by Nesbitt. However, according to the shareholders lawyer, Harvey Strosberg, he need not prove the anti-competitive action to use the act since the act also applies to consumer protection involving false advertising.

Drabinsky, Gottlieb accused of fraud
Article Abstract:
Livent Inc.'s new management has filed a lawsuit against Livent founders, Myron Gottlieb and Garth Drabinsky, in the Ontario Court's General Division, charging the two former executives of committing fraud that cost the company over C$97 million during the past five years. The suit contends Drabinsky and Gottlieb took kickbacks amounting to over C$7.5 million and manipulated the company's books, pocketing millions of dollars more. Drabinsky and Gottlieb, on the other hand, filed a counstersuit that seeks C$105 million in damages against Livent and its new managers after none of the charges filed against the duo has been proved.
