Litigation grows in ailing nursing home industry

The number of lawsuits against nursing homes in the US has grown by 9% for the past five years since 1994 while the average amount of claims have increased from an average of $64,015 to $112,351 for the same period. Industry insiders say that lawyers who specialize in nursing home litigation have made it existence more difficult for an industry that is already in financial distress, lacking in manpower and has a bad public image.

The nursing home industry faces debt, staffing and profit problems that threaten the future of around 1.5 million Americans spread throughout the country's 17,000 facilities. Poor business management and a decline in Medicare payments covered by the Balanced Budget Act of 1997 have been cited by industry officials as primary reasons for the possible cuts in operations and closure of some units.

Nursing-home chains in financial trouble indicate widespead weakness in the nursing-home sector. Vencor, once revered by Wall Street analysts, is the latest nursing-home company to file for Chapter 11 bankruptcy protection. The financial problems faced by the nation's nursing-home companies are being blamed on Medicare caps mandated by Congress in the Balanced Budget Act of 1997. Adding to the present financial crisis is the huge outstanding debt incurred by the chains to support their expansion programs in the early 1990s.
