HMO cut costs at the expense of care, plaintiff says

Carle Clinic, a health maintenance organization (HMO), is facing a federal case filed by Cindy Herdrich under the Employment Retirement Income Security Act. Herdrich underwent an emergency surgery after a misdiagnosis. Although she won $35,000 from the HMO's doctor in a state malpractice suit, Herdrich and her lawyer, James Ginzkey, took the case to the Supreme Court to challenge the federal law that prohibits patients from suing HMOs over managed-care decisions.

Tobacco youth ban is toppled
Article Abstract:
The US Food and Drug Administration (FDA) does not have the authority to regulate tobacco, ruled the Supreme Court. The court ruled that the FDA overstepped its limits when it ruled that the tobacco products are under its purview because they contain nicotine. The court said that the FDA lacks a mandate from Congress to extend its regulatory powers to tobacco. The ruling is a serious blow to the Clinton administration's program to stop teenage smoking.

The Hollywood film industry may shy away more decisively from future motion pictures about the 1775-1783 US Revolutionary War likely because of the disastrous results of the big-budget, 1985 film 'Revolution,' and the controversy aroused by the 2000 film 'The Patriot.' Historically, the industry has produced roughly only 10 Revolutionary War pictures, all of which have uneven track records. Furthermore, experts believe that the Revolutionary War has inspired fewer movies than any other US war because of a number of factors, chief among them being the fact that the American colonials dressed strangely and appear to have espoused beliefs that smack of right-wing Christian dogma.
