The psychotherapist-patient testimonial privilege
Article Abstract:
Testimonial privilege for psychotherapists concerning evidence about their patients has been upheld by the U.S. Supreme Court in the 1996 decision in Jaffee v. Redmond. Nevertheless, as in other forms of testimonial privilege, there are numerous exceptions, with the result that patient information is rarely shielded by the privilege. In practice, confidentiality is protected only when the information is shown to have no materiality or relevance to the case.

Plea bargaining
Article Abstract:
Legal plea bargaining arises from a practical necessity to reduce the high number of cases in the court system and to offset the risks of prosecuting and defending by benefits. The risk for the prosecution is to conduct a lengthy and expensive trial and be faced with acquittal. The risk for the defense is to suffer conviction with the maximum sentence.
