Article Abstract:
Several recent cases underscore the importance of drafting real property contracts and leases with great care. In Michigan, LaFond v. Rumler warned against failing to provide for a third-party fallback if a specific transaction should fail. In New Mexico, Cox v. Hanlen was a further reminder that the existence and scope of easements should be explicit. Finally, a flurry of cases showed the complications in drafting anticipatory leases between landlords and tenants.
