Article Abstract:
Conveyancing practice is particularly afflicted with inappropriate and unhelpful rules, but complaints about certain provisions or proposals are often unheeded by the law makers. There are suggestions that conveyancers should avoid entering into contracts, following uncertainty about section two of the Law of Property (Miscellaneous Provisions) Act 1989. The property industry forced a major reworking of clause 37, due to Customs & Excise's ignorance of property law, and there are other problems where the rules separate the instrument of the transaction from the event.

Article Abstract:
Rent deposits do not seem to have become more popular in the UK as a result of the Landlord and Tenant (Covenants) Act 1995, which prevents landlords from accumulating covenants from successive tenants and sureties. For most rent deposit deeds, this legislation has the effect of ensuring that the obligations of both the landlord and the tenant are automatically transmitted to the successor. Tenants gain full release from their liabilities when they assign with consent, but this does not apply to landlords.

Must a surety guarantee an AGA?
Article Abstract:
Since the UK Landlord and Tenants (Covenants) Act 1995 abolished privity, with effect from Jan. 01 1996, UK landlords are increasingly insisting that sureties are still liable as guarantor of the tenant even after the tenant has assigned. Landlords argue that this is the case where tenants remain liable under an authorised guarantee agreement. However, closer examination of the Act shows that this argument is not valid. Article further discusses the issue.
