Article Abstract:
It is very common for commercial property deals in the UK to include confidentiality clauses. There are also other circumstances in which confidentiality conditions apply, such as in the case of arbitration proceedings. In most cases, confidentiality clauses do not cause difficulties, but there may be problems when a subpoena is issued by a party to a dispute. Expert witnesses involved in arbitration proceedings must take great care when balancing a subpoena against an obligation of confidentiality.
