The increase in UK shopping centre developments has led to a rise in legal cases which have challenged some past legal rulings. Landlords were found to be liable for the poor behaviour of tenants and once they had been alerted they had a duty to resolve the issue. Occupiers should take note of a case concerning a landlord letting premises to two banks in nearby outlets and draw up a covenant which stops similar businesses being able to open in their vicinity. Shopping centre developers were found to within their rights to restrict access to their property by people who had behaved badly.

Retail heaven: converting the city centre faithful
Article Abstract:
It is anticipated that the new 600 million, 120,770 sq mt Trafford Centre in Manchester, England, will be fully let by Christmas 1998. It is widely acknowledged that Peel Holdings has gone to great lengths to use high quality fittings and to create an upmarket atmosphere, but some observers have expressed reservations about the centre's ability to attract enough key tenants. Marks and Spencer has decided not to open an outlet there, and this has deterred some other retailers.
