Time runs out for safe renewals
Article Abstract:
Several decisions in the UK courts concerning renewals of planning permission were not consistent with each other. Developers can either use section 73 in the Town and Country Planning (Applications) Regulations 1998 and request the time limit on an application is extend. Alternatively the developer may renew the planning permission under regulation 3. Two of the cases differed over whether applying to increase the time limit, under section 73, was in fact a renewal and therefore liable for reconsideration from the planning authority.

Recent developments have provided clarification on the issue of what precisely is the legal test for determining the materiality of a planning obligation as related to a linked planning application. It is now clear that a planning obligation may be entered into unconditionally or subject to conditions, and that it may operate indefinitely or have limited operation. The payment of money has now been specifically sanctioned as a main objective of a planning obligation.
