What are fixtures? - life after the Botham decision
Article Abstract:
A High Court judgement on whether certain everyday items in a dwelling were fixtures or chattels has important implications for those buying or selling properties. In the case of mortgagee TSB Bank PLC versus mortagor Botham, the judge ruled that fitted carpets, light fittings, gas fires, curtains, towel rails, kitchen units and electrical white goods were all fixtures and therefore subject to stamp duty. Most property lawyers and private individuals have long regarded such everyday objects as chattels, which do not incur stamp duty.
