The difficulty in deciding what can be classed as a permanent fixture in a property or a fitting which can be removed once the property is sold was highlighted in a recent court case. The court's decision held that an object should not only be removable without inflicting damage to the area with which it was in contact but whether it had been seen as an integral part of the property. This may have implications for the previous owners of properties which have been repossessed.

The universal capital gains exclusion for the sale of a principal residence is one of the most important tax changes in the Taxpayer Relief Act of 1997. Taxpayers can now treat homes as assets under the new tax law rather than a place to live. However, high transaction costs, low immediate cash flow, and illiquidity of investments are some of the considerations and qualifications that taxpayers and homeowners need to treat when selling their residences.
