Banks fear loophole in data bill

A close investigation of the UK's Data Protection Bill, which must be in force by Oct 24, 1998, indicates that data processed for the prevention or detection of crime is protected by non-disclosure provisions, but that there is no basis for the information being held in the first place. This means that banks, finance companies, credit organizations and insurers, which play a valuable role in preventing and detecting fraud, will not be able to process sensitive data held for crime and fraud prevention purposes. The government is now coming under pressure to address this problem.

Most people only need to seek the services of a solicitor at times of considerable stress, such as moving house, making a will or setting up a business. This makes it particularly important to find a solicitor who is sympathetic and helpful. People are now being more careful about their choice of solicitor, and will often visit several before making a decision. Cost is an important issue, but for difficult matters it may be advisable to pay a higher rate for a solicitor who has the relevant experience.

The law relating to personal injury cases in the UK currently requires the person who has been injured to prove that the defendant has been negligent in some way. It is not unusual for defendants to fight extremely fiercely against being found negligent, and this can cause considerable problems for plaintiffs and lead to very high costs. It is now becoming increasingly widely accepted that reversing the burden of proof in some personal injury cases could significantly reduce the cost of litigation.
