Beware of the small claims court. It may be a toothless watchdog

It is widely recognized in the UK that the small claims court system can offer an informal, low-risk approach to resolving disputes. However, this system could be undermined by the fact that many claimants are unable to recover the money they are owed, even when the small claims court finds in their favour. Some experts believe that problems with the small claims court system could be made worse by the top limit for claims being increased to 5,000 pounds sterling in Apr 1999.

The UK's Proceeds of Crime Act 1995 gives the Crown Prosecution Service's Central Confiscation Branch (CCB) wider powers to investigate the finances of criminals and to remove their assets. The CCB is able to confiscate so-called 'clean' income, such as lottery winnings, as well as gains made through crime. Confiscation orders can be very tough, and a criminal defaulting on payment will no longer be able to eliminate his debt by serving a longer prison service.

There is growing concern about the way in which the Criminal Injuries Compensation Board uses its discretion to withhold or reduce awards of damages to victims of crime. Some observers believe that the situation may get worse as the government plans changes to the compensation scheme. It is seeking to introduce a tariff-based scheme with fixed amounts for each injury, but this is being opposed by the House of Lords.
