It is clear that Microsoft founder Bill Gates has shown himself to be an extremely successful businessman. He has been able to focus on developing, defending and exploiting a significant market opportunity, and has been able to establish a very strong presence in certain key areas of the PC software market. As such, he is part of a long tradition of very successful businessmen. However, some observers are beginning to view him rather negatively. In particular, there is concern about why the free market and anti-trust and competition laws have been unable to stop Microsoft gaining a dominant market position.

Moves by Microsoft to establish an extremely dominant position in the software market have the potential to damage democracy and market freedom, according to Ralph Nader, an experienced campaigner for consumer rights. Microsoft has in the past been oblivious to any criticism of its commercial tactics, but pressure from Nader now seems to be eliciting a response. Indeed, Microsoft founder Bill Gates has stated that he feels his company is being subjected to a witch-hunt. Nader claims that he has never in his long career seen a company use such ruthless tactics as Microsoft.

The US Justice Department is taking legal action against Microsoft, and the case illustrates the importance of control of markets for managers. They can cut risk levels and boost profits if they can dominate markets. The US has understood this drive better than the United Kingdom, and has strong anti-trust laws, in contrast to those of the UK. Microsoft rejects claims that it has an operating systems monopoly and claims that it has achieved its position due to the production of better products.
