On the liberating virtues of irrelevance
Article Abstract:
The US Supreme Court's refusal to include social science research in its decisions about the death penalty means social scientists can emphasize research on aspects beyond strict questions of constitutionality. Social scientists, who tend to oppose capital punishment, are free to study abolition in other countries, attitudes of the public toward executions, policies in the US, lawyers who specialize in capital sentence appeals and the effect of executions on victims, prison personnel and other members of legal system.

Three metaphors for a new conception of law: the frontier, the baroque, and the South
Article Abstract:
Modern times are characterized by an inability of science and technology to solve man's problems and by the inability of the law to further the cause of human emancipation. If sociolegal scholars had a new paradigm for thinking about their field, this would be the beginning of a solution to the problem. This new paradigm needs traits of frontier, baroque and Southern legality. These three factors have in common subjectivity and sociability and as such will further the cause of emancipation.
