NIH wins patent on basic technique covering all ex vivo gene therapy
Article Abstract:
NIH's new patent for one of the basic gene therapy techniques, developed by W. French Anderson, has caused a significant controversy because its broad nature opens it to challenges. The patent demonstrates the shift in patent law away from utility proofs to encourage venture capitalist investments by making patents more available to fields where efficacy trials occur in the later stages of development. Already, lawyers for Somatics, who holds a patent on ex vivo gene therapy, are planning to challenge the patent which would require all commercial gene therapy developments to have a license from the exclusive licensee, Genetic Therapy Inc.

Gene therapy approval may be rocky road for industry
Article Abstract:
The recombinant DNA Advisory Committee (RAC) of the US National Institutes of Health has approved the progress of the gene therapy trials of Viagene, the San Diego-based biotechnology company. The biotechnology industry, however, has not accepted RAC's involvement in the approval of gene therapy trials for an experimental therapy for AIDS. The future relationship between RAC and the industry will be influenced by such disagreements in the technicalities of clinical trials.
