Adjudication has arrived
Article Abstract:
A dispute between Morrison Construction and groundwork subcontractor Macob Civil Engineering has provided the first case law for the 28-day adjudication decisions made under the Construction Act. The ruling in this case indicates that an adjudicator's decision is binding if the adjudicator has answered a question actually referred to him. The successful party must get the court to summarily enforce this decision, while the disappointed party may challenge the decision by calling for an arbitrator or through litigation.
