Federal Circuit rulings damage patent law
Article Abstract:
The US Court of Appeals for the Federal Circuit has greatly weakened safeguards against invalid patents. Many of the more than 100,000 US patents issued annually fail to meet statutory standards for patents and subvert the patent system unless invalidated in the courts. The Federal Circuit has exclusive appellate jurisdiction in patent cases but the hope that a single appellate court would increase uniformity and predictability has not materialized.

The affirmative duty of a potential patent infringer with knowledge of another's patent rights to use due care in investigating their possible infringement is discussed. This investigation usually includes the duty to seek competent legal advice, and the waiver of the attorney-client privilege is discussed.
