Franchise tying occurs when the franchisor illegally ties the renewal or purchase of a franchise to the purchase of a product or service. Courts' interpretations of what constitutes this practice, as well as franchisors' obligations, are reviewed.

The use of Daubert and its progeny to attack lost-profit claims

The author reviews notable US Supreme Court and state court decisions on the use of expert opinions to determine lost profits in franchise cases. Tips for asserting and defending against so-called Daubert challenges are presented.

Proving entitlement to preliminary injunctions against franchisees
Article Abstract:
The use of the preliminary injunction to fight unfair competition and trademark infringement by a terminated franchisee is discussed. A franchisor's Lanham Act claims should help the granting of the injunction.
