Article Abstract:
US v Emerson, a case on the right to bear arms pending in the United States Court of Appeals for the 5th Circuit, is discussed. The defendant in the Emerson case was indicted on illegal firearms possession, and 100 amici curiae range from the National Rifle Association on one side to law enforcement on the other.

Circuit cases spell trouble for INS laws; equal protection issue may lead to a judicial backlash
Article Abstract:
The effort to change the gender-based practice making it more difficult for the illegitimate, foreign-born children of male US citizens than for similar children of female US citizens to become citizens themselves is discussed. Many expect the US Supreme Court to void the law on equal protection grounds in Nguyen v. US, a 5th Circuit case the court has granted certiorari.

Pleas: justice or bribery? 10th Circuit hears arguments on whether to outlaw federal plea bargains that require testimony
Article Abstract:
The Department of Justice views the common prosecutorial strategy of offering lower sentences to defendants in exchange for their testimony as crucial to its mission, but John Wachtel is arguing in US v. Singleton that this strategy violates the federal bribery statute. Wachtel has made this argument for the past two years. Singleton is a 10th Circuit case and has caused many motions to exclude testimony or reverse old convictions in the six states that make up this circuit. There are also two bills pending before the Senate Judiciary Committee that would amend the bribery statute to exclude prosecutors from the law.
