Prominence counts in pro bono appearances
Article Abstract:
Marc Galanter and Thomas Palay's idea to improve legal services to the poor by letting law firms meet mandatory pro bono duties by paying other law firms to represent the poor has much to recommend it, but an additional step is needed. The courtrooms where the poor seek justice are disproportionately occupied by the powerless, and prominent attorneys willing to represent the poor can have a positive influence on the dignity of courtroom atmosphere and the upholding of the rights of the poor. Prominent attorneys can protect the legal rights of the poor more effectively than anyone else.

Recusal can deny cert
Article Abstract:
Recusal of a Supreme Court justice from a case can cause the court to deny certiorari even to the party supposedly protected by the recusal. Three remedies are evident: amendment of the judicial code to let a plaintiff waive the recusal for certiorari purposes only, retention of retired Supreme Court justices to fill in when a sitting Justice is recused, or allowing certiorari to be granted with three affirmative votes rather than four when one or more justices are disqualified.

The presidential campaign is off to a dirty start
Article Abstract:
Republicans should not criticize Pres Bill Clinton's judicial selections but should remember that Republican presidents have made mistakes selecting judges too. Better yet, all should remember that even the best judges make mistakes and that it is unfair to blame each ruling on the president who appointed the judge. The judiciary should not be politicized.
