Most landlords will not take advantage of their right under the Landlord and Tenant (Covenants) act 1995 to write into new leases the conditions which a prospective assignee must meet, according to property experts. They will not attempt to balance out loss of privity of contract by including oppressive clauses in new leases. The Association of British Insurers has emphasised that landlords' consent to any reasonable assignment should be retained in new leases.
