Judicial Independence: The control of the purse by courts
Article Abstract:
Control of tax money is always understood to be a domain of the legislature and a source of immense power, however, courts have now increasingly asserted control over portions of the public money justifying it on grounds of judicial independence. Thus, the clash between legislative control and judicial control threatens to dilute traditional notions of the legislative power of the money.

The Chief Justices of two states and a retired justice of the US Supreme Court discuss the complexity of judicial independence and impartiality of America's courts and judges. They observe, among other things, that the country's judiciary is strong and believe it is the job of judges to rise above the attacks on the judiciary even if they find them unfair.
