Article Abstract:
A San Jose, CA, race-and-gender-based public contracting outreach programme has been condemned by the California Sixth District Court of Appeals. This is the first decision made by a state appellate court about the implementation of Proposition 209, the 1996 anti-race-and-gender-preference initiative, at local level. If the California Supreme Court does not overturn the District Court of Appeals' ruling, local preference programmes that have been made acceptable by using artificial race-neutral language will become invalid. This ruling highlighted a number of key issues, including the interaction between Proposition 209 and federal law.

Bypassing politics as usual
Article Abstract:
The use of California's initiative process may enable a bypassing of the Legislative to introduce school vouchers as a means of reforming Californian education. The methods used are similar to those used by the high-tech industry in Silicon Valley.
