Experts fear Hong Kong legal system in peril; despite predictions, law society president believes reversion to Chinese rule will not erode freedoms
Article Abstract:
A US district judge's ruling in Nowak v Tak How Investment Ltd sparked a furor in Hong Kong when it expressed doubt the British colony's legal system will survive its reversion to Chinese rule intact. Roderick B. Woo, president of the 3400-attorney Law Society of Hong Kong, responded with an attack on the West's lack of confidence. Many China experts in the US echo the judge, however, saying that at least in the short term China is unlikely to respect all the rights citizens now have in Hong Kong.

Experts tackle torts restatement; product liability gets first review; design defects and warnings at issue
Article Abstract:
The American Law Institute is writing another torts restatement, about 30 years after the first one, which was published in 1965. This edition will begin with product liability. James A. Henderson of Cornell Law School and Aaron D. Twerski of Brooklyn Law School are to be the reporters. They are the authors of a Sep 1992 article in the Cornell Law Review calling for a revision of section 402A of the Restatement (Second) of Torts. They wish to solicit both plaintiff and defense points of view.

Tort awards increasing: experts peg rise to decreased publicity about tort reform, profit-driven corporate decision-making

Statistics show that tort awards are increasing. According to Jury Verdict Research, which maintains a data base of personal injury verdicts and settlements, the national average for personal injury verdicts went up 17% in 1995 to $62,000, the second annual increase in a row. Opinion varies as to what the statistic means, with some attributing the decline to less tort coverage in the media and some just seeing a random fluctuation.
